Privacy Policy for LinkedIn

1.    Preliminary remark

Pharmaserv GmbH ("we") is very delighted that you have shown interest in our company profile. Data protection is a high priority for us. We take your privacy very seriously and would like to inform you through this privacy policy about which personal data is processed when you visit our LinkedIn company profile, to what extent and for what purpose.

We would like to point out that you use our LinkedIn company profile and its functions on your own responsibility. This applies in particular to the use of the interactive functions (e.g. commenting, sharing, rating). Alternatively, you can also access the information offered on our LinkedIn company profile on our website at https://www.pharmaserv-logistics.com/.

2.    Joint Controllers

Together with LinkedIn Ireland Unlimited Company (LinkedIn), Wilton Place 2, Dublin 2, Ireland, we are joint controllers for data processing on our company profile pursuant to Art. 4 No. 7 of the General Data Protection Regulation (GDPR).

LinkedIn is a subsidiary of Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA, based in the United States.

We have entered into an agreement with LinkedIn regarding processing as joint controllers. This agreement is available at: https://legal.linkedin.com/pages-joint-controller-addendum.

In this agreement, we and LinkedIn have agreed, among other things, that

  • LinkedIn will ensure that LinkedIn users are informed about the processing of their personal data and will support them in exercising their rights of access and erasure;
  • the Irish Data Protection Authority monitors data processing by LinkedIn Page Insights.

3.    Data processing on LinkedIn

3.1    General
LinkedIn is generally responsible for the collection and further processing of personal user data on LinkedIn websites. Please note that LinkedIn collects and processes certain information about your visit to our LinkedIn company profile even if you do not have a LinkedIn user account or are not logged in to LinkedIn. For information on the processing of personal data by LinkedIn, please refer to LinkedIn's privacy policy at https://www.linkedin.com/legal/privacy-policy.

3.2    Purely informative visit to our LinkedIn company profile
If you only use our LinkedIn company profile for information purposes, i.e. if you neither are logged in nor otherwise transmit information, we do not collect any data from you.

However, we would like to point out that LinkedIn automatically collects and stores information in the server log files that your browser transmits to LinkedIn. This is usually data that is technically necessary to display the website to you and to ensure stability and security.

As a rule, this data consists of

  • Referrer (previously visited website)
  • Requested web page or file
  • Browser type and browser version
  • Operating system used
  • Device type used
  • Time of access
  • IP address

3.3    Cookies
When you visit our LinkedIn company profile, LinkedIn also places cookies on your device. Cookies are small files that are stored on a visitor's device (e.g. computer or smartphone).

3.4    Your profile, contact requests and contributions
As the operator of a LinkedIn company profile, we can only view your public profile on LinkedIn. The information that can be viewed here depends on your settings in your profile. In addition, we process your personal data (such as your name and the content of your messages, inquiries or other contributions to us or on our site) if you contact us via our LinkedIn company profile.

We process this data for the purpose of reviewing your posts accordingly or, if necessary, responding to them. Depending on the reason for and content of the conversation, this processing is based either on our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR, in particular in order to be able to contact you in response to your inquiries or contributions, or on Art. 6 para. 1 lit. b GDPR if your inquiry is aimed at concluding a contract with us.

3.5    Page Insights
LinkedIn also provides us with Page Insights. If you visit, follow or otherwise interact with our LinkedIn company profile as a member, LinkedIn processes personal data to provide us with Page Insights. In particular, LinkedIn processes data that you have provided as a LinkedIn member, such as your position in the company, country, industry, length of service, company size and employment status. In addition, LinkedIn processes information about how you interact with our LinkedIn company profile, e.g. whether you follow our page.

LinkedIn only provides us with aggregated, i.e. anonymized, data as part of Page Insights. LinkedIn does not provide us with any personal data of members in Page Insights, regardless of their status as joint controllers. LinkedIn also does not allow us to link the information from Page Insights to individual members.

This data processing is based on our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR, in particular to recognize user preferences (e.g. number of so-called followers, number of views of individual page areas, user statistics by age, geography and language) and to be able to adapt and improve the offer on our LinkedIn company profile to suit the target group as much as possible.

4.    Third country transfer

It is conceivable that some of the information collected may also be processed outside the European Union by LinkedIn in the USA. The USA is currently considered by the European Commission as a country that does not have an adequate level of protection for personal data. To ensure an adequate level of data protection, LinkedIn bases such transfers on standard contractual clauses approved by the European Commission and the EU-US Privacy Framework. Nevertheless, it is possible that authorities in the USA, including law enforcement agencies and intelligence agencies, may access or otherwise gain knowledge of your personal data and you may not be entitled to any legal remedy against this.

5.    Data deletion and archiving

We store your personal data on our systems, i.e. outside LinkedIn, if and for as long as it is required for the purposes for which it was collected or if there are legal obligations to retain it.

6.    Your rights

You have the following rights vis-à-vis us with regard to your personal data:

6.1    Right to information (Art. 15 GDPR)
In principle, you have the right to receive information about the points mentioned in Art. 15 GDPR. You also have the right to request a copy of your personal data in accordance with Art. 15 para. 3 GDPR.

6.2    Right to rectification or erasure (Art. 16 and 17 GDPR)
You have the right to have incorrect personal data concerning you corrected. In addition, you have the right to request the erasure of your personal data if further processing is no longer necessary, the processing is unlawful or you have withdrawn your consent.

6.3    Right to restriction of processing (Art. 18 GDPR)
If the requirements of Art. 18 GDPR are met, you have the right to restrict the processing of your personal data, i.e. to prevent further processing for the time being.

6.4    Right to data portability (Art. 20 GDPR)
Within the limits of Art. 20 GDPR, you have the right to receive your personal data in a machine-readable format in order to forward it or have it forwarded to another controller if necessary.

6.5    Right to complain
In accordance with Art. 77 GDPR, you also have the right to complain to a data protection supervisory authority about the processing of your personal data by us.

6.6    Right to object to the processing (Art. 21 GDPR)
You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Art. 6 para. 1 lit. e or f GDPR, including profiling based on those provisions.

We will no longer process the personal data concerning you unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.

If your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data for such marketing, which includes profiling to the extent that it is related to such direct marketing.

If you object to processing for direct marketing purposes, your personal data will no longer be processed for these purposes.
